Terms of Service:

By commissioning work from ,K. A, aka Tricksparrow (The Artist) you (The Client) agree that you have read and agree to be bound by the terms of this agreement in letter and spirit. This agreement may be changed at any time without notice.

When requesting a commission The Client:

- Understands that the The Artist reserves the right to refuse a commission for any reason.

- Agrees to be as specific as possible when providing visual reference or text descriptions of the image you are commissioning.

- Agrees to provide all reference material no more than 5 days after entering into this agreement.

-Agrees to allow The Artist to use/post and reproduce the commissioned work to advertise their skill.


The Artist WILL NOT create images that contain:

- Sexually explicit content. (This includes any hard-core images but excludes nudes/erotic art. Please mail to discuss the distinction)

- Any explicit, nude or erotic/sexual content that features a minor or minor aged character.

- The promotion of ANY kind of hate-crime.

- Copyrighted characters. (Fan characters are okay)


Pricing

Posted commission prices (which can be found here: [link] are a basic estimate and will increase with the difficulty and/or complexity of an image. Should this become necessary, The Artist will inform The Client that a change in the agreed-upon price is required OR a re-evaluation of the image being commissioned may be discussed.


Updates

The Artist will provide progress updates to The Client on a regular basis; how regular is to be agreed upon by both parties. If no determination is made, The Artist will update only when significant progress has been made to the commission.

An "update" will consist of a visual or textual show of progress mailed to The Client via their preferred method of contact.

Revisions and Deadlines

-  Sketch stage: Revisions are allowed until The Client is satisfied with the basic concept of the commission.

Opportunity for revision will be presented to The Client at each further stage of the commission.

Payment information

Payments are to be made in USD and are accepted via PAYPAL to the following address: Trick_Sparrow@hotmail.com

100% payment is due upon receipt and approval of a sketch by The Client. Further work will not begin until the funds are received by The Artist.


Violation of TOS

Should The Artist's Terms of Service be violated by The Client for any reason, The Artist reserves the right to terminated the agreement and refund an amount corresponding to the completion level of the image, as outlined in the "Refund Policy" section.

Refund Policy

Refunds will be issued based on the stage of completion of an image at the time the refund is requested or the agreement is violated or dissolved as demonstrated below:

- Sketched: 75% refund
- Line Art: 50% refund
- Flat color : 45% refund
- Partially shaded: 40% refund
- Fully Shaded/Missing detail or BG: 20% refund
- Full rendered, completed image: No refund at this stage.

A refund may only be requested in the case of a gross over-site, an irreconcilable difference or disagreement with The Artist.

The Client will be sent a MEDIUM quality version of the commissioned image (whatever the current level of completion) and issued a refund within 5 business days.

*Paypal fees are not included in the refund pricing and will not be covered by The Artist.
